Chapter 7
Chapter 7 of the bankruptcy code deals with liquidation. The bankruptcy code is the name given to that portion of the federal laws that deal with bankruptcy. Under Chapter 7, the debtor must turn any nonexempt property over to a trustee who then converts the property into cash and pays the debtors' creditors. In return, the debtor receives Chapter 7 discharge if he or she pays the filing fee, is eligible for the discharge, and obeys the orders and rules of the bankruptcy court.
Chapter 13
Chapter 13 lets a person repay all or a portion of his or her debts under the supervision and protection of the bankruptcy court. The debtor must submit a plan for the repayment of all or a portion of his or her debts to the court. The court must approve the plan for it to become effective.
